CONCILIAÇÃO, ARBITRAGEM, MEDIAÇÃO: formas adequadas à solução de conflitos em prol da pacificação social.

Abstract

The present work aims to explore the extrajudicial means of conflict resolution as a form of social pacification. For this purpose, legislative, bibliographical and jurisprudential research was carried out. At the beginning of the research, the methods of conflict resolution were approached in a general way, starting with historical and conceptual aspects. Subsequently, the research brings the concept of self-defense and self-composition. The chapter ends with aspects of judicial protection and their equivalents. In more peculiar ways, the hererocomposition is approached, giving a special focus to the arbitration. Self-composition is also treated again, bringing the concepts of conciliation and mediation. Finally, the research presents resolutions of the National Council of Justice demonstrating the concern of the judiciary to demonstrate the importance of methods of conflict resolution as a means of social pacification.
