O PRINCÍPIO DO NON-REFOULEMENT NA PROTEÇÃO DOS REFUGIADOS NO BRASIL E INTERNACIONALMENTE

Abstract

This paper addresses the Principle of Non-Refoulement in the protection of refugees both in national territory and internationally. Such an approach is necessary because the refugee is persecuted on political and religious grounds, so the national legislation must guarantee the refugee's security and protection. The purpose of this study is to understand the refugee's legal status and what obstacles he or she will have to face in order to take refuge in an unknown, new country. This intent will be achieved through the analysis of case studies and bibliographic review. The study also analysed the displacement process the refugee goes through once he crosses national borders, as well as the refugee's legal, condition to be recognized.
