Abstract

This paper adresses the criminal liability of the legal person in environmental crimes. Such an approach is due ti the fact that it is difficukt to punish the legal person for ervironmetal crimes. The purpose of this study is to clarify the way in which the legak person will respond criminally for the crimes committes, as well as to point out the constitutional legal security. This purpose will be achieved through the literature review. The discussion of the topic contrinutes to a reflection on the criminal liability of de legal person for environmental crimes, as it is clear that there is still a greay doctrinal divergence as to the possibility of applying penal sanctions to legal entities, and the possible effects of this responsibility. Finally, the juridical person must be held criminally responsible when he commits crimes, since he has a collective will of his own, as a result of the deliberation of his organs, and this will allow him to act in the legal word.
