O INQUÉRITO POLICIAL: prescindível ou imprescindível?

Abstract

This work has the goal to analyses if the police inquiry is dispensable or essential on the production of evidences, so that a procedural instruction is subsequently instituted. Such an approach is due because in some cases, there is already sufficient evidence to prove the authorship of the crime, and it is not necessary the establishment of a police investigation. The main goal of this analyses is demonstrating the importance of the production of evidences trough of such investigation. All the study done in the course of this research became evident that the police investigation is really essential, since, with the current Federal Constitution, considered a mark with regard to the guarantees of fundamental human rights the police investigation took on a new aspect, working as a real guarantee for justice to be truly fair and cautious, because is trough of this diligent instrument of judicial police which the real truth of the facts is unveiled in an impartial way, which does not always lead to the indictment of the person under investigation, but which may prove his innocence.
