LEI MARIA DA PENHA: Uma análise de sua efetividade no meio social

Abstract

This paper analyzes the effectiveness of the Maria da Penha Law in the social environment. It studies more broadly how the Maria da Penha Law was conceived and the process to achieve the goal of eradicating domestic violence and transforming the people involved in the cycle of violence. Thus, out of the need to cease such offenses and make it a truly effective law, criminal proceedings were created to protect the victim and prosecution to punish the perpetrator. Therefore, it is of paramount importance the work of a multidisciplinary team and public policy agents during the process and the fight against domestic violence against women. In this line, the objective of this monographic work is to research within the academic context the discussion about this law by studying its concepts, historical and legislative evolution of women's rights, including the study of the International Conventions, the urgent protective measures in order to To analyze the effectiveness of criminal proceedings, the challenges to make the Maria da Penha Law broadly effective, and the effectiveness of public policies. The technique used to perform this work was through bibliographic research, thus, readings were made in legislations, doctrines, electronic articles and jurisprudence that manifest themselves on the subject. This will be an innovative approach, which will allow us to understand the complex phenomenon of gender violence, allowing the modification of the thinking and the way of acting against domestic violence.
