REPRODUÇÃO “IN VITRO POST MORTEM”: direitos sucessórios do embrião

Abstract

This article approach the inheritance rigths of the embryo born by the use of post mortem reproduction. Such an approach is necessary since the Brazilian legal system does not exist a law that completely regulates assisted reproduction, especially regarding posthumous reproduction.The objective of this article is to seek possible solutions to the problems created in inheritance law in view of the use of post mortem technique. This purpose will be achieved through the literature review, which will verify the understanding of doctrineers about post mortem reproduction, as well as the inheritance rights arising from its use. The analysis showed the need for the embryo to be guaranteed inheritance rights, thus guaranteeing it in the hereditary vocation.
