ALIENAÇÃO PARENTAL

Abstract

The parental alienation consists in the psychological intervention in a child’s or adolescent’s consciousness through acts on which the genitor or alienating parent makes use of devices to hinder, impose blockages and ruin the minor’s affectionate relationship and companionship with the genitor and the alienated person from the family. In order to eradicate such acts and refrain the victims from unleashing the Parental Alienation Syndrome – SAP (abbreviation in Portuguese) , in August 26th, 2010, the number 12.318 law was established, which settles the parental alienation, making society aware of its existence and orientating the law professionals on means to recognize and defeat it. Although it’s been recently dealt by the legislation, it’s a problem that has long existed in the family relationships, and it has normally been taken into effect after the marital relationship’s ending, in which one of the parents seeks to make use of the minor as means of revenge to affect the other. Before that, this study aims to handle the child’s and adolescent’s judicial protection regarding the parental alienation syndrome, basing upon the understanding of doctrines, legislations as well as current jurisprudences.
