Abstract

This paper discusses the main issues of the jury of the institution , particularly with respect to the constitutional principles that are affections. Initially a brief summary of the historical evolution of the Jury was carried out and presented the main features of the procedure in international law and in Brazilian law . Special emphasis was given to the guiding principles of the jury , such as the secrecy of voting , the sovereignty of the verdicts and full defense , which are analyzed in the light of the doctrine and jurisprudence dominant . Finally, it created a critical analysis of the procedure especially the unconstitutionality of the principle in dubio pro societate and the illegality of the use of evidence obtained during the police investigation .
