DIGNIDADE NO CÁRCERE: mães presidiárias e o direito das crianças e dos adolescentes à convivência familiar

Abstract

The present study deals with the conditions that imply female imprisonment in Brazil, as well as its rules and at the same time inquires whether the constitutional, penal and procedural assumptions are being observed. Initially the research deals with the evolution of prison systems, highlighting the Pennsylvania, Auburnian and Progressive systems, highlighting the influences on the Brazilian Prison System. Subsequently, the work deals with criminal execution, bringing concepts about the penalty, its principles and its species, as well as the types of penal establishments provided for in the legislation. The work is also concerned with bringing some peculiarities regarding women prisoners, rights to gestation, breastfeeding, family life, among others. Finally, it addresses sensitive issues such as the situation of the pregnancy and the children of mothers in custody, dealing with the maintenance of the family and affective bond and the possibility of granting house arrest.
