Abstract

“The way in which the urbanization process took place, together with the growth of cities resulted in the precariousness of man's ways of living. This entire process resulted in changes” (MONTEIRO; VERAS, 2017). Thinking about this urban structure of cities and transformations in the population's way of living, the great challenge of housing demand in urban centers today requires solutions that improve the quality of life, and meet the demand for more adequate and satisfactory housing alternatives . As a research problem, this study asks: “How is the structuring process for the implementation of horizontal condominiums in the municipality of Boa Esperança, taking into account the current legislation (2021)?”. Among the worked hypotheses: There are several bureaucratic obstacles to the implementation of a horizontal condominium as well as its regularization. As well, a new local law on subdivisions presents specific benefits to these projects. The study analyzes, before an exploratory research, the execution process of the so-called horizontal condominiums, as well as obstacles, investigating professionals who directly participated in this process. The study has in its objectives: to understand the practical implementation considering the current master plan of the city. Therefore, the benefits generated to developers and the problems caused are verified, generating an important source of consultation for people who will go through these bureaucratic processes, clearing up doubts. The fundamental motivation for dealing with this topic is due to the fact that there is a great demand for this type of enterprise even in inland regions, causing investments to be made by several companies in this segment, in compliance with the demand of the real estate market current.
