Abstract

This paper addresses the issue of environmental displacement and its lack of legal definition and its consequences, given the vulnerability of this group in a century in which climate change tends to intensify. As a result, it is observed that the issue of migration of individuals, bearing in mind the history of persons considered asylum seekers and refugees, as well as the protection and protection granted to them through international agreements as well as the role of the United Nations for study of ideas for the appropriate solutions to the group that so far has no legal definition or instruments capable of providing them with the necessary. Analyzes, therefore, the situation of those who move as a result of environmental disasters and are forced to leave their home and family to seek shelter in another territory, and there may be displacement within the state in which the disaster occurred or even outward displacement. their home state, thus having the problem of lack of legal instruments to bring them the necessary security. Yet, without proper protection, their fundamental rights are violated, thus hurting their human rights. Thus, this paper examines fundamental legal principles, such as solidarity and responsibility among states, principles that will guide the construction of security and protection mechanisms for environmental displaced persons.
