Abstract

This work addresses shared custody. Such an approach is justified because it demonstrates the different ways of defining shared custody based on marital ruptures. The aim of this study is to present the diversities of family organization and clarify the roles of parents and their responsibilities, just that the roles between each parent should be divided, as in the past only one parent exercised custody and also the family power, and the one who was outside paid child support and visits, but visits over time stopped and the pension is still one of the biggest causes of the judiciary, so shared custody came to equal rights and duties of parents towards their children. This purpose will be achieved through literature review. This research evidenced factors that should be addressed in various judicial spheres, they are: the importance of the child living with both parents, the traditional gender roles, which were previously only represented by the mother, and the definition of custody based on moral issues , as an example to blame.
