A INFLUÊNCIA DA MÍDIA NO TRIBUNAL DO JÚRI: conflito entre a liberdade de imprensa e a imparcialidade dos julgamentos.

Abstract

This paper seeks to demonstrate the influence of the media on the decisions of the Jury Court Sentence Council and the conflict between press freedom and the impartiality of judgments. Such an approach is necessary, since the media repercussion of the cases brought to the jury court, when exercised in an unruly manner, can directly affect the penalty applied to the accused, injuring their constitutional rights. The purpose of this paper is to analyze the formation of opinions by common sense, press freedom as factors that help in convincing the members of the sentencing council. This purpose will be achieved through bibliographical research, based on renowned scholars, such as Guilherme de Souza Nucci, Fernando Capez and Nestor Távora.
