| metadata.dc.description.resumo: | Assunto corriqueiramente abordado nos seios familiares são os alimentos, os quais visam garantir os direitos fundamentais, como a sobrevivência, saúde e dignidade da pessoa humana, tratando-se de um dever de mútuo auxílio entre os entes familiares. Em virtude disso, os avós possuirão o encargo alimentar subsidiária e complementarmente, uma vez que serão fixados nas hipóteses de ausência ou insuficiência financeira dos genitores. Perante essa situação, o presente trabalho não tem a pretensão de esgotar o tema, mas demonstrar objetiva e sucintamente, à luz da legislação, doutrina e jurisprudências, a responsabilidade alimentar atribuída aos avós. |
| Abstract: | Commonly talked-about subject matter at families’ gatherings is the maintenance obligation, which aims to ensure that fundamental human rights such as the right to life, health and dignity of human being are protected, it is a reciprocal obligation among family members. Because of that, grandparents will be legally required for maintenance obligation, which is subsidiary and complementary, when a parent cannot be found or when the parents can prove they are unable to support the children. In view of that situation, the present study does not intend to exhaust the theme, but rather to demonstrate objectively and succinctly, in the light of legislation, legal doctrine and jurisprudence, the grandparents’ maintenance obligation. |
