Abstract

The theme presented itself already allows us to observe the problematic nature of this study; the term "organized crime" suggests something challenging to state standards since it is real to their engagement with society. As a crime, we understand something lawful that counteracts the criminal law or any established legal dictum that seeks to conduct acts of citizens in the goal of the common good in your desired harmony. Organized as crime is currently more is presented clearly, but disguised, in order to circumvent the legal state systems based on the pursuit of this social harmony. And as the goal of CO, as noted, is to overcome the legal means to achieve the maintenance of its existence, use, therefore, vulnerable beings also not made by law for the exercise of their illegal functions. In the interim, the Criminal Organization, is supported and fed by the state failures, or the various state apparatuses, to its indented and survival. In this way it gives the maintenance of organized crime, using vulnerable beings that are not properly protected by the state machine, striving for corruption of organizational sectors and the illicit enrichment. At the end, it is shown that the existence and survival of organized crime only occurs due to the State's failure and government institutions as well as the omission of all Brazilian, because the state itself is formed by the participation of all.
