MERCOSUL e Integração Regional: a consolidação de instituições comunitárias como forma de garantir a segurança jurídica internacional

Abstract

This paper aims to demonstrate the importance of the process of integration in a globalized world, especially among the nations of the countries that make up the Mercosur, in the face of international law. Also, show the concepts and different opinions of the doctrinators on the subject. Although the Southern Common Market is not yet at the threshold of Community law, it is the regional organization most tending towards community building, evolving as regional integration progresses through its treaties and the concern to institutionalize a community. The theme is so important that it leads to an analysis of the dilution of the concept of state sovereignty and the elaboration of the concept of integration between nations in the light of human rights, while the dilemmas and challenges generated in the process of regional integration need to be implementation of common legal solutions that consolidate legal certainty at the international level. Therefore, the legal evolution of the aforementioned institutions builds the pillars of the process of Latin American integration in the international order. Thus, by understanding the concept of community law and how integration among the nations of the Mercosur economic bloc contributes to the protection of fundamental rights, it is possible to guarantee the guarantee of free access to jurisdiction in the states and respect for equality of rights.
