O FENÔMENO PSICOLÓGICO DA PSICOPATIA E SUA IMPLICAÇÃO JURÍDICA

Abstract

The present work has the objective of analyzing the phenomenon of psychopathy, and brings up pertinent questions to the imputability of the psychopath before the Brazilian penal order. In this path will be presented the primordial characteristics of such individuals, as well as the peculiarities on imputability in criminal law. In addition, it will address real cases of psychopaths that have ravaged the Brazilian reality in order to demonstrate the effectiveness or otherwise of the penal system in relation to them. All of the above is done with the primary purpose of demonstrating the effectiveness or ineffectiveness of the Brazilian punitive system in the face of the situation of the psychopaths in order to demonstrate the pertinent ideals about the best way of acting freight to these.
