ASPECTOS JURÍDICOS SOBRE A LEI GERAL DE PROTEÇÃO DE DADOS PESSOAIS - LGPD

Abstract

This paper analyzes the main aspects of the General Law for the Protection of Personal Data – LGPD. Such an approach is justified by the fact that in a globalized world, whose digital borders are practically non-existent, individuals need to have their fundamental rights provided for in the Federal Constitution, with greater evidence of the inviolability of private life, honor and image. The purpose of this study is to understand the relevance and pertinence of the topic today, seeking historical, sociological and constitutional support to delineate the limits of the LGPD, while verifying the effectiveness of the provisions of the LGPD. This purpose will be achieved through the technique of bibliographic and documental review. The study also sought to deconstruct the idea of the existence of a conflict between the norms of access to information and protection of personal data, through the use of the technique of weighting values.
