ABANDONO AFETIVO INVERSO E AS SANÇÕES CIVIS DELE DECORRENTES.

Abstract

This paper aims to analyze the possibility of applying the institute of civil liability and disinheritance in cases of inverse emotional abandonment as a form of penalty, with the scope of reducing the occurrence of such a situation. Such an approach is necessary given the number of abandoned elderly people in the country who do not resort to civil law to minimize the damage caused by emotional abandonment, probably because they do not know their rights. It mentions what civil liability is about, as well as what disinheritance is about, and the issues are also related to the problem of inverse affective abandonment. It is also mentioned the relationship of inverse affective abandonment with the Brazilian Federal Constitution, with the Jurisprudence and also with the Elderly Statute. The method used in the construction of the work was especially exploratory research. Civil law works, IBGE and IPEA surveys, current legislation and information obtained from electronic sites were used. It is considered correct that children are condemned to pay compensation resulting from the abandonment of their parents, as well as that they are excluded from the succession through disinheritance.
