| metadata.dc.description.resumo: | O presente estudo tem a intenção de investigar a dicotomia jurídica entre as restrições ao direito à liberdade de ir e vir, que a administração pública se usou para promover proteção ao direito à vida. Direitos Fundamentais, confrontantes, constante a Magna Carta de 88 do ordenamento Brasileiro, sob a égide do cerceamento advindo de cenário da pandêmico do Covid-19, agente Sars-Cov-2. O avanço do aparato estatal sob a vida dos indivíduos quando impõem medidas de restrições do direito da livre circulação e o do direito de reunião, com fim de estabelecer condições à manutenção da ordem pública, preservação do direito à saúde e o bem estar coletivo. Tendo como base legal o Art. 5º e Art. 196 da Constituição Federal de 1988. |
| Abstract: | The present study intends to investigate the legal dichotomy between restrictions on the right the freedom to come and go, which the public administration used to promote protection of the right to life. Fundamental Rights, confronting, constant the Magna Carta of 88 of the legal order Brazilian, under the aegis of the restriction arising from the scenario of the Covid-19 pandemic, agent SARS-CoV-2. The advancement of the state apparatus under the lives of individuals when they impose measures of restrictions on the right of free movement and the right of assembly, in order to establish conditions for the maintenance of public order, preservation of the right to health and well-being collective. Based on Art. 5 and Art. 196 of the Federal Constitution of 1988. |
