DEMISSÃO POR JUSTA CAUSA DECORRENTE DE OPÇÃO POR NÃO ADESÃO À VACINA DA COVID-19

Abstract

This paper deals with fair dismissal resulting from non-adherence to the COVID-19 vaccine. Such an approach is justified by the need for legal certainty in labor/employment relations. The purpose of this work is to reflect upon the jurisprudence and legal position on the application of fair dismissal to the employee for refusing to get the COVID-19 vaccine. This purpose will be achieved through research. The analysis showed that the subject under study is new in the legal field, without legislation that deals directly with it and, also, that there is still no statement from the Superior Courts.
