INVESTIGAÇÃO CRIMINAL: garantias fundamentais

Abstract

The present work aims to analyze the constitutional rights and fundamental guarantees assured to the investigated during the criminal investigation. The issue is extremely important as it focuses on police action and individual rights, issues that are constantly debated in the legal and social circles. Initially, it seeks to bring a brief distinction between the existing procedural systems. At a later moment, the research brings some concepts about the police investigation to finally bring constitutional concepts of rights and guarantees expressed in the Magna Carta. The work seeks to bring divergent positions in the doctrine on the in(validation) of the principles of the contradictory and ample defense in the investigative procedure. The objective of the research is to demonstrate that the limits and characteristics of the investigation cannot exceed the investigated person due to arbitrariness or even the strict application of the law. The work was carried out through research in the relevant legislation, doctrines and jurisprudence.
