ADOÇÃO POR CASAIS HOMOSSEXUAIS NO DIREITO BRASILEIRO

Abstract

This work deals with the possibility of adopting homosexual couples in Brazilian law, and there is no prohibition for this adoption to occur, what happens is the lack of a specific law on the subject, leaving room for debate. It also talks about how the institute of adoption works and what its guiding principles, as well as the requirements that the individual needs in order to achieve the adoption, habilitation and effects that this form of family produces in the legal order, also deals with the relationships homosexuality and homosexuality, from the homoaffective union that came to be equated with the stable heterosexual union from the judgment of the STF. And finally, it discusses the possibility of same-sex couples to adopt and the problem that is the lack of specific law that regulates the adoption by these couples.
