| metadata.dc.description.resumo: | O presente trabalho de conclusão de curso traz informações significativas sobre o uso de drogas para consumo próprio e informações sobre a inconstitucionalidade do artigo 28 da Lei n°. 11.343/06. Inicialmente, traz ao leitor o conceito de drogas aceito pela Organização de Saúde, bem como dados históricos. A seguir, trata da previsão no ordenamento jurídico, trazendo os princípios e objetivos do Sistema Nacional de Políticas Públicas sobre Drogas, instituído pela lei de drogas atual. Uma análise detalhada sobre o porte de drogas é necessário, por esse motivo o trabalho aborda sobre os sujeitos do crime, análise do tipo, objetos material e jurídico, bem jurídico tutelado e a classificação geral do delito. Os elementos usados pelas autoridades policial e judiciária são abordados, demonstrando a subjetividade utilizada no reconhecimento de usuários de drogas. Por fim, o trabalho traz posições contrárias e positivas acerca da descriminalização e inconstitucionalidade do artigo 28 da Lei 11.343/06. |
| Abstract: | The present work of conclusion of course brings significant information about the use of drugs for own consumption and information about the unconstitutionality of article 28 of Law no. 11,343 / 06. Initially, it brings to the reader the concept of drugs accepted by the Health Organization, as well as historical data. Next, it deals with prediction in the legal system, bringing the principles and objectives of the National System of Public Policies on Drugs, established by the current drug law. A detailed analysis on the possession of drugs is necessary, for this reason the work deals with the subjects of the crime, type analysis, material and legal objects, legal guardianship and the general classification of the crime. The elements used by the police and judicial authorities are addressed, demonstrating the subjectivity used in the recognition of drug users. Finally, the paper poses contradictory and positive positions on the decriminalization and unconstitutionality of article 28 of Law 11,343 / 06. |
